Resident Rights Under Georgia Law
Specialized Property Management operates in full compliance with Georgia O.C.G.A. Title 44 Chapter 7. Residents have specific rights including a 30-day security deposit return after surrender of premises (§ 44-7-34, with up to 3x the wrongfully withheld portion plus attorney fees if a landlord owning more than 10 units or using a management agent withholds in bad faith — § 44-7-35), the right to a habitable property (§ 44-7-13), protection from unlawful utility shut-off (§ 44-7-14.1, with a $500 statutory penalty), the right to a move-in inspection list when the landlord owns more than 10 units, and the right to file a written answer to a dispossessory affidavit within 7 days of service (§ 44-7-51). For City of Atlanta residents, security deposits are capped at 1.5 months’ rent. We provide these rights in plain English at lease signing — not buried in fine print.
